    I had the fluid changed when I bought the car All levels are correct
    ANd I am not sure if the car had been modded or not the Engine still looks like you could eat off of it. A shift kit was the first thing I thought of but that should shift hard up and down no??

    Without knowing anything about the car it is hard to say if a problem was built into it to cause this. If you have an aftermarket reprogrammed pcm then this makes sense as you shouldnt have a harsh downshift from 40mph which you are likely dropping back into 1st gear which was common on older aftermarket pcms. A stock pcm will not allow a kickdown into 1st gear at that speed. What are your full throttle upshift rpms at? If they are at around 5800 rpm then you have an aftermarket pcm your shift points will be this high, stock ones are set at around 5400 but often shift at 5600. If the pcm is stock then you could be having some trans problems such as worn clutches or some valve body problems.
