    Man that sucks people here in AZ drive like ****, it amazes me how tough our DUI laws are and stupid people still drive drunk.

    ricio- I can try to clear up a couple concerns possibly. I have been in lots of wrecks, 5 Grand Prix total losses so far if you can believe it. Gonna try to keep this short.

    Everyone has told you right about getting paid for you and your passenger's losses. Check your insurance ID card or policy, but most basic liability packages have a UI coverage. Thats the underinsured / uninsured part. They wouldn't sell many policies if that wasn't included. Since nobody was hospitalized, your claim should be within that coverage range.

    Forget about the drunk ass-wipe and forget the lawyer. Blow that steam off best you can and speak softly and frequently to the insurer's claims people you deal with. Politeness. Since you will be dealing with your own insurance company instead of his, they have every reason to take good care of you. However, I don't know whose policy you have, and I have been with the same ins co for near 35 years with multi cars and a house too. So maybe I am giving the rose colored version but I doubt it. I also fixed wrecks for many years and all this is way familiar to me. What has to happen for swift action is for you to alert your agent that you have a claim and are in pain and rideless. Nobody can do anything until the accident report comes from the police.

    As SOON as you can get that report to your claims people, if it says the other party was uninsured they will immediately get you a rental for until a decision is made and your claim is settled. If you study your policy you will probably also find that up to five grand or so, you are covered after any accident no matter whose fault, to go see a doctor. So no delay is necessary for medical treatment. Here again, they wouldn't sell many policies without that.

    Keep the car. This is gonna be one of the first questions you are asked. "Would you like to keep the salvage?" If the ins co gets it (and they will offer a semi-decent scrap price then hurry up to come get it) the title is branded as a total loss. If you keep it, you can sell the salvage as a whole or part it out. Whatever you like, but the title is unaffected. Your little title loan should be paid off immediately, in my opinion. Just so theres no conflict, and heck you could sell parts for the $ to do it.

    The other reason to keep the car is because anyone who rebuilds them knows that since you have a clean title, its worth more than if the ins and JY got it right off the bat. Clean titles alone are sellable in some cases. Just remember also, that somebody may offer for example $700 for the whole thing as-is. That same person might pay $800 for a good running engine / trans / frame out of the car. Meaning the $200 or so the junk man will give you for the rest is bonus if you pull that out. Plus all the door panels and stuff like that which are good could be sold and it won't affect scrap price much at all.

    I prolly said plenty right there .... did I miss anything lol I did follow along the whole post but may have missed something else.

    Thank you so much for the information. Well i did go the lawyer route but im going to get a declaration form to see what my coverage is. So laywer has a body shop theyre going to do an appraisal on the damages. I might lose out on alot of money but thats something im ready for but ima try my best to get my insurance pay my medical bills since i have ui policy. I just want her to pay for the consequences so she doesnt do it again with me im just lucky to be alive and i can always buy another car.

    It's not just a AZ thing. Licenses are issued to easily nowadays and there's so many unlicensed,uninsured drivers driving around and if they get pulled over.. It's usually just a stupid ticket and a slap on the wrist.

    They should impound uninsured vehicles untill proof of insurance is present but that would never happen. When I registered my car in Ohio them mailed me a letter saying I need to provide proof of insurance or they suspended my rego.
