so we have a new supervisor and she's a total B****. I work 12hr shifts at Smithfield and we get an hour lunch at midnight and at 5am we get a 30min break, starting friday we're only getting 1 break and its a 70min lunch break...?? I was gonna fight it but I found this on NC-labor board website:

    BREAKS — What to Know

The North Carolina Wage and Hour Act (WHA) does not require mandatory rest breaks or meal breaks for employees 16 years of age or older. The WHA requires breaks only for youths under 16 years of age. Youths under 16 years of age have to be given at least a 30-minute break after 5 hours of consecutive hours and no break of less than 30 minutes shall be deemed to interrupt a continuous period of work. Again, there are no required rest breaks or meal breaks at all for employees 16 years of age or older. The North Carolina law on breaks for youths under 16 years of age generally applies only to enterprises that have gross sales or receipts of less than $500,000.00 a year and to private non-profit organizations. It is our understanding that the federal Fair Labor Standards Act (FLSA) does not require that an employer give its employees mandatory rest breaks or meal breaks regardless of an employee's age.

NC is freakin' retarted...just another reason to hate it here...

what is some of yall's views on this? legally smithfield is right but its F'd up!

That sucks. The thing that sucks more is you cannot do anything about it. I am surprised that they do not even require the employer to give you any sort of a break.

Does the company have a Union? If so, look in the contract for a loop-hole.

Work in a hospital like I do....12 hour shifts and never off your feet... we get a break but pending patients and emergencies... it could get shortened. I like my job thought!

well i orginally wanted to go to college but I was sooo close to deployment, it didn't matter. I had to squeeze in 30 credit hours in a semester...Obviously that aint happening but only problem with that quicklynx is i'm already making good money. but here recently cut hours back, absoutely no-over time. I don't even get 40 hours. Thats why i'm ready to get deployed dec 1st and get this mess done with so I can step up in the world.
