    I know this is not the best place for this but hey what are friends for right? I have already contacted an attorney who is supposed to be calling me back with advice but I just wanted to see what you guys thought about this.

    I am out on an injury to my wrist until its healed. My follow appointment is set for June 20th and at that time it may or may not require surgery depending on the determination .I am just now beginning to recieve workers comp. My child support is now a whole one day late for the first time ever. It was agreed divorce and nothing was court ordered. Its payed to her monthly and it goes directly to her and no through the state. She called getting hateful threating to turn it into the state so that I would have to pay it to them now that its late. Saying she has to have it by Friday and that I have to have something set back for it at which I do not. I told her that she should have been saving part of the support for emergency situations for like this instead of fully including basing into her monthly budget. The support is more than 400 every month that I give her. Anyone got some information to help with this? I told her as soon as I that the full amount I would i give it to her as I always have.

    since its not court order then she cant do really much of anything i would think,
    i would tell her to chill out and she'll get it when she gets it

    You kidding, this is probably one of the best places to look for legal advice since most of us I'm sure have had to deal with court as our cars are modded LOL. My girl works for a law firm so I'll ask her if she has any advice. Might be different though as you're in a different state. At least you can claim you have always been paying until this injury.

    I got a call from the workers comp insurance company. They are mailing out a check to me tonight. It will cover the problems. It will be here in 5 -7 business days at the most. I informed her of it thinking that she will be happy to know she will recieve her support with that time frame and that I could give her what little I could to help for the meantime. All she could do was say "that does not help me, and now I will have to pay a late fee on my rent. You dont understand that it doesnt matter what the hold up might be that you still have to pay that!".

    It blows my mind to think I was acctually married to this woman at one time. She is so self-absorbed its crazy.

    The problem I was having is determining if there was any sort of grace period or what not on the child support. It was not court ordered but it is in the parenting plan that we both signed and I did not want any legal hassle over being late. I love my son to death and would do anything i had to do for him.

    If she needs money for food or something is something I would take care of. I cant give her something that I dont have though. Before the divorce was final I got laid off from my job of 7 years. I recieved a separation package from them. At the time we were separarted but were attempting to work things out for the sake of my son but it did not happen. I made the mistake of telling her about the separation package. At first she was like oh you deserve it and then about a week later she came at me hard trying to get it claiming she needed things for our son. I offered to buy them but that was not good enough. She wanted the money in hand.

    ya know what, let her take you to court (or better yet, you take her to court, the one who makes the first move always seem to come out on top) and get the amount lowered that you pay every month, that will teach her to ***** and moan. you make less money now vs when the divorce happened so you may have a chance to pay less. now that will piss her off, won't it.....lol

    Its a funny thing you mention that. When the divorce was final the child support was based unemployment. I had just lost my job of 7 years and it was the same time the economy crashed. I pay out 422 a month in support that was based off 1300 a month in unemployment benefits. I made the mistake of being thick headed and not paying attention by signing the parenting plan that said I only got my son "every other weekend" when i was physcially picking him up everyday from daycare until she got off work. It was my fault and I still get angry at myself for not paying attention at what was going on. The job i currently have pays more than unemployment but since i'm out on workers comp I'm not really sure how that would work out if I decided to do that. He is getting ready to start pre-school and her monthly expenses are going down when that happens as the daycare he goes to now costs 130 a week which is deducted directly from her paycheck. But anyway, its a long drawn out story that I could go on and on about LOL

    take her to court and sue for joint custody then, all you split then are cloths and medical bills, and you have your kid for a whole week at a time. sounds like you want to be in his/her's life so why not?

    anything and everything is negotiable in court. as long as you can get the kid to school on your weeks it should be a easy score.

    The only problem with that is that I now have a 2nd shift job. I work 4pm to 12:45 am. I took so I could go back to college this fall. I'm tired of dead beat jobs and I want to be able to do more with him and my girlfriend who currently supports me to no end and I am so very thankful of. I'm not really sure if that would work well in my favor becasue I would be at work all the time and now I am only getting him every other weekend like the parenting plan indicates. But like i said before, in the past the time I had with him was far from what the court "thought" i had with him.

    I have been in my sons life ever since he was born and thats the way it will always be. My dad left when I was about two weeks old and he has never made a claim to me from the get go. I made a vow to myself and my son that I would never be the looser that my dad was. I know all this may seem petty and childish and in many ways it is. I am only trying to do whats best for 1. him and 2. myself and the people that matter most to me.

    it aint easy being a stand up guy, after your done with school i'd go for the joint custody thing, only thing that sucks about having a kid and breaking up is your stuck with the mom for 18 to 21 years, and having to be her fake friend for the kids sake.

    good luck.

    my ex had a kid and his father was a complete loser, he'd blow off his kid on his weekends, witch mess up our plans for the weekend, but even worse is a 7 year old looking out the window and crying because he feels like dad forgot about him. truth be told he was to busy getting high on crack and heroin. nice guy.

    oh and he paid 35 bucks a week support and couldn't make that happen, at one point he was 6 grand in the rears. hows that for a dirt bag!

    the kid ate more than 35 bucks worth of food a week, never mind cloths and toys and everything else that goes with kids.

    Sorry a little late, but my girl just got back to me on this. They don't do anything with family law so they wouldn't know. Of a personal experience with a friend in the last few days. If it's not court ordered, you should be fine, but even if it was, they usually don't do anything until the $1000 range. If she knows someone in the court though, she might be able to have something done sooner. A NJ State trooper told us they don't arrest you anymore until it's at least $500.

    I'd make sure it's court ordered or your at least getting a receipt for it, my buddy worked with a guy that paid his child support directly to his ex and when the kid turned 18 she went after him for unpaid child support and he had to pay it all again because he had no proof he paid it. I personally have custody of my son and his mom gets him every other weekend and she is supposed to pay $5.16 a week but i haven't got paid in about 4 years now, which comes out to just about $1000.
